The opportunity

The Contracts Specialist - Assistant Director role will provide inputs to the commercial and contracting proposition prior to qualification of managed services pursuits, review and align the proposed commercial and contractual positions during RFP’s and when required support / provide the negotiation function for those pursuits.  The role will also provide post agreement contract management support and may be expected to support an APAC wide contract management functionality.

 

Your key responsibilities

  • Support the design of competitive commercial terms for managed services deals – working closely with the pursuit leader, solution architect, legal, pricing, negotiations, risk, and independence.
  • Support the review of client proposed commercial and contracting terms in order to provide for a balance of competitiveness and risk avoidance – working closely with the pursuit leader, solution architect, pricing, legal, quality, risk, and independence.
  • Support commercial and contract negotiations working with the Pursuit Lead and Engagement Partner while supported by Legal and QRM for strategic deals.
  • Support development of existing contract templates and T&C’s during pursuits and negotiations working with legal.
  • General support to pursuits in the commercial and contracting space including creation and negotiation of preparatory contracts (NDA’s, teaming agreements, sub-contracts and the like)
  • Support the qualification process of strategic pursuits – consulting appropriately to provide commercial value to EY whilst mitigating key risks.
  • Consult to make appropriate choices of contract structures and templates and align the templates to pursuit needs and client requests. Choose or re-draft alternative appropriate clauses.
  • Support the transfer of the commercial and contract knowledge to the EY delivery teams to ensure the ongoing management of the commercial and contractual aspects of contracts.
  • Capture knowledge into EY artefacts that can be used to support strategic pursuits
  • Escalate and provide insights to QRM practitioners as part of the qualification and negotiation process in order to gain approval for the proposal and for changes to the contract / constructs during negotiation.
  • Apply experience and appropriate delegation of authority guidelines to ensure that EY does not deviate from its approved contractual positions without appropriate governance.


Skills and attributes for success

  • A high level of drive, ability to work independently and deal effectively with ambiguity and change,
  • Business and commercial acumen,
  • Commercial and contracting expertise in managed services and other complex and sensitive pursuits,
  • Fluency and experience in all commercial constructs, pricing methodologies and relevant commercial contracting terms and conditions,
  • Experience in supporting the negotiation of significant contract and or commercial arrangements,
  • Capable of leading a small geographically distributed team in a complex delivery environment,
  • Attention to detail, and able to produce work of consistently high-quality under pressure,
  • Ability/credibility to influence key EY and client stakeholders on robust commercial strategies & outcomes that is reflected in your personal style, experience and approach,
  • Experience gained on best practice managed services and other commercial arrangements and ability to translate these for EY pursuits, 
  • Strong written and verbal communication skills appropriate to client operational level and EY senior stakeholders.


To qualify for the role, you must have

  • The candidates will have a Law degree, and/or a Post Graduate Business or Contract Law qualification.
  • 10+ years of post-qualification experience with minimum 7 years of practical contract management or similar experience gained in a top tier professional services firm.


Ideally, you’ll also have

  • ITIL and service management experience (example creation, negotiation and management of Service Level’s / KPI’s & Service Credits)
  • Able to demonstrate the required influence and appropriate gravitas and persuasion skills towards EY Partners, pursuit team and external clients
